Philosophy of Law: The Fundamentals

Review

"Mark Murphy is the most interesting and original natural law theorist of his generation, and this wide-ranging, learned, and lucid introduction to legal philosophy will be the text of choice for any student or philosopher who wants a philosophically sophisticated survey of the major topics that, at the same time, makes clear the continuing attraction of the natural law tradition." Brian Leiter, University of Texas at Austin "Murphy executes a masterly and enlightening challenge to fashionable claims that ‘all is not well’ with the law and its philosophy. Fully accessible to general audiences, his book will also inform and engage the specialist reader." William A. Edmundson, Georgia State University "Philosophy of Law itself is a well designed book on several levels ... Murphy hooks you from the start." Stuart Hannabuss, Aberdeen Buisness School, Robert Gordon University “A concise, well balanced, and articulate discussion. The author has the capacity to present complex material with ease to its audience… A highly captivating interpretation of the philosophy of law” Internet Law Book Reviews

From the Back Cover

Beginning with the deceptively simple question "What is law?" Philosophy of Law introduces readers to the basic analytical and normative issues in the field. The volume is a wide-ranging text that discusses the concepts of law, highlights key historical and contemporary thinkers who have shaped the discourse, and provides a unified treatment of the various issues in the philosophy of law. Murphy frames the discussion with three central commonplaces about law: that it is authoritative, that it is a social matter, and that it is for the common good. Enlivened with numerous everyday examples, this text is an important resource for students coming to the subject for the first time.

I am a real person, and I also used this book as a textbook to teach a college course on, 'The Philosophy of Law'.So, I can say, fairly definitively, that this book is a terrible example of analytic philosophy getting way out of hand. With no mention of any actual philosopher, like Aquinas, Hobbes, Locke, etc., this book creates a whole hierarchy based on the contemporary roles of people in our justice system today. For example, he invents the word 'commonplaces' to talik about the things we all know and hold in common about the law.Next, he breaks all law down to the categories of Legislator, Subject, and Judge. His dicussion of torts and other law is non-sensical and difficult to read / comprehend. What is, the Philosophy of law, anyway? As a Prof, I would think that the idea of legality goes back to the Ancient Greeks, is talked about by Aquinas, and then there were the social contract theorists, etc. Beyond that, you have real law, as in what happens in the courts today.. That is not really philosophy - that is knowledge of the current legal system in America. Take a law course. So, I would have to say that this book is not really philosophy - it is 'Law' for Dummies, but with no real historical basic / content for it. He just invents these things out of thin air, deconstructing 2000 years of real Philosophy. I can't see how this would be helpful for anyone in any way. You can the sum book up in a few pages. Not worth it. I don't even think there is a decent text on the Philosophy of Law, as it is barely a well defined discipline, as it is.

For a philosophy of law class this read is very comprehensive. I recommend this book for those who want to know fundamentals since this book is great covering the basic stuff on principles of law. Also, in comparison to Dworkin and other philosophers of law, Murphy does a great job explaining difficult things in very easy way to grasp.

This is a difficult course on its own, but the book makes it a lot easier to understand.

Clear and well-organized but incredibly dull. It's too abstract and removed from the practice of the law (Murphy barely cites a dozen cases in the entire book) to hold the interest of anybody who isn't already familiar with (and interested in) the questions discussed.
